2. Acceptance of These Terms

By using our website, creating an account, starting a trial, purchasing a service, enrolling in a program, or participating in any EonYoga offering, you confirm that you have read, understood, and agreed to these Terms & Conditions.

If you do not agree, do not use the website or purchase or participate in our services.

3. Important Consumer Notice

Nothing in these Terms is intended to exclude, restrict, or waive any rights you have under applicable law where those rights cannot lawfully be excluded or limited.

If you are a South African consumer, these Terms must be read subject to applicable provisions of the Consumer Protection Act, the Electronic Communications and Transactions Act, POPIA, and any other mandatory law that applies to the transaction.

4. Eligibility and Participant Responsibility

You confirm that:

- you are at least 18 years old, or you are using our services with legally valid parent or guardian consent where that is allowed

- the information you provide to us is accurate and complete

- you will keep your account, password, and access credentials secure

- you will notify us if your contact or billing details change

- you are responsible for ensuring that a training, class, workshop, retreat, or program is suitable for you before enrolling

Some programs may have prerequisites, experience requirements, attendance standards, or certification requirements. We may refuse or cancel enrollment if prerequisites are not met or if participation would create a safety, legal, or operational issue.

5. Our Services

EonYoga may offer:

- online yoga memberships and subscriptions

- free trials

- on-demand digital classes

- online teacher training

- in-person teacher training

- continuing education courses

- live webinars, workshops, and events

- retreats

- corporate wellness services

Descriptions, pricing, dates, schedules, inclusions, and requirements published on the relevant product or program page form part of the transaction. If a specific program page includes terms that differ from these Terms for that program, the specific program terms apply to the extent of the difference.

6. Website Use and Accounts

You agree not to:

- use the website for unlawful, abusive, fraudulent, or harmful purposes

- interfere with website functionality, security, or other users

- copy, scrape, reproduce, resell, or exploit our content or services without permission

- share paid account access or restricted materials with others

- attempt unauthorised access to accounts, systems, or content

You are responsible for activity that occurs through your account unless you promptly notify us of unauthorised use.

7. Orders, Pricing, Currency, and Payment

All prices are listed in the currency shown on the relevant page and may be updated from time to time.

You are responsible for:

- reviewing the full offer before purchase

- ensuring that billing information is correct

- paying all applicable charges, taxes, fees, and instalments due

We may use third-party payment providers to process payments. By making a purchase, you authorise us and our payment providers to charge the payment method you provide for the relevant amount and for any recurring payments you agree to.

If a payment fails, we may:

- retry the payment

- suspend or terminate access

- cancel enrollment or participation

- require another payment method

Deposits, instalment plans, and due dates are binding once agreed. Failure to complete payments may result in suspension, removal from a program, or withholding of certificates or access until the account is brought current, subject to applicable law.

8. Free Trials, Subscriptions, and Auto-Renewals

Where offered, the online library may include a free trial period. By starting a free trial, you agree that:

- the trial converts to a paid subscription unless cancelled before the trial ends

- the payment method you provide may be charged automatically at the end of the trial for the plan you selected

- subscriptions renew automatically until cancelled

Monthly subscriptions renew monthly. Yearly subscriptions renew annually unless cancelled before renewal.

You may cancel an online library subscription before the next billing date through your account settings, where available, or by emailing `hello@eonyoga.com`.

Cancellation stops future billing only. It does not normally create a refund for charges already processed or for unused time, except where required by law.

If South African fixed-term consumer protections apply to your plan, any rights you have under applicable law remain in force.

9. Refunds, Cancellations, and Transfers

9.1 Online library memberships

You may cancel before your next renewal date. Access continues until the end of the paid period already billed. No partial or prorated refunds are normally given for unused subscription time unless required by law.

9.2 Digital products, online trainings, and continuing education

Because digital products and online programs typically provide immediate access to protected content, purchases of digital courses, online teacher training, continuing education, and other downloadable or streamed content are final and non-refundable once access has been granted, except where required by applicable law.

If the law gives you a cooling-off or cancellation right, that right applies only to the extent it is legally available and has not been lawfully waived by your request for immediate access or immediate performance.

9.3 In-person and hybrid trainings, workshops, retreats, and events

Unless a specific program page states otherwise, the following applies to in-person and hybrid programs:

- a deposit may be required to secure your place

- deposits are non-refundable unless we cancel the program or the law requires otherwise

- if you cancel more than 28 days before the program start date, we will normally refund 75% of tuition paid

- if you cancel 14 to 27 days before the program start date, we will normally refund 50% of tuition paid

- if you cancel 1 to 13 days before the program start date, we will normally refund 25% of tuition paid

- if you cancel after the program has started, no refund is normally available

Any published refund percentage applies to the total tuition paid for that booking and is not in addition to any deposit already paid.

Transfers to another cohort, date, or format are not guaranteed. If we agree to a transfer, it may be subject to:

- availability

- a price difference

- a reasonable administration fee

- updated terms for the new offering

Failure to attend without written cancellation is treated as a cancellation.

9.4 Cancellations required by law

Where mandatory consumer law gives you cancellation, cooling-off, refund, or renewal rights that are more protective than these Terms, those legal rights apply.

10. Schedule Changes, Venue Changes, and Force Majeure

We may make reasonable changes to:

- dates

- times

- venues

- teachers or facilitators

- program structure

- delivery format

- content sequencing

This may happen because of illness, safety issues, travel disruption, low enrollment, venue issues, technical problems, government action, force majeure, or events beyond our reasonable control.

If we materially cancel a paid program, we may offer a rescheduled place, transfer, credit, or refund, as appropriate and as required by law.

We are not responsible for your third-party costs such as flights, accommodation, visas, insurance, time off work, or other personal arrangements, except where the law requires otherwise.

11. Attendance, Assessments, and Certification

Teacher training and certification programs may require:

- attendance

- practicum participation

- assignments

- quizzes or exams

- observation hours

- live sessions

- conduct standards

- final assessments

Payment alone does not guarantee certification.

Certificates are issued only when all required standards have been met to EonYoga's reasonable satisfaction.

If you miss required hours or assessments, we may require make-up work, additional mentoring, additional fees, or a later completion timeline before issuing certification.

Where a program references Yoga Alliance recognition, your own registration with Yoga Alliance or any other accrediting body remains subject to that body's separate requirements, processes, and fees.

12. Participant Conduct

We expect respectful conduct toward instructors, staff, venues, hosts, and other participants.

Harassment, discrimination, intimidation, unsafe behaviour, disruption, unauthorised recording, or misuse of materials may result in:

- warnings

- restricted participation

- removal from a session or program

- cancellation of access or enrollment without refund where justified

13. Health, Safety, and Assumption of Risk

Important notice: yoga, breathwork, meditation, movement practices, physical adjustments, workshops, retreats, live classes, and teacher training involve inherent risks. These risks include strain, aggravation of existing conditions, emotional discomfort, falls, physical injury, illness, and, in rare cases, serious injury or death.

By participating, you confirm that:

- you are voluntarily taking part

- you understand these inherent risks

- you will practice within your own limits

- you will stop if you feel pain, dizziness, distress, or discomfort

- you will seek medical advice before participating if you are pregnant, injured, unwell, under treatment, or have any condition that may affect safe participation

- you will tell us about relevant injuries, limitations, or health concerns where appropriate

To the fullest extent permitted by law, you accept the ordinary inherent risks of participation. EonYoga does not exclude liability for fraud, gross negligence, wilful misconduct, or any liability that cannot lawfully be excluded or limited.

For in-person, high-risk, or live practical offerings, we may require you to sign or positively accept a separate health and risk acknowledgment before participation.

14. No Medical or Therapeutic Advice

Our website, classes, trainings, and materials are provided for educational and wellness purposes only. They are not medical, physiotherapy, psychological, psychiatric, therapeutic, legal, tax, or financial advice, and they are not a substitute for professional diagnosis or treatment.

15. Intellectual Property and Limited Licence

All website content and all program materials, including:

- videos

- recordings

- manuals

- course materials

- text

- graphics

- trademarks

- branding

- downloads

- class structures

- learning resources

are owned by EonYoga or licensed to us and are protected by intellectual property laws.

When you purchase or access a service, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the materials for your own individual, non-commercial use.

You may not, without written permission:

- copy or distribute materials

- record, reproduce, or republish paid content

- resell or sub-license access

- share logins

- create derivative training products from our proprietary materials

16. Testimonials, Reviews, and User Content

If you voluntarily send us a review, testimonial, comment, image, or similar content, you grant us a non-exclusive, royalty-free licence to use, reproduce, adapt, and display that content for business and marketing purposes, unless you ask us not to.

We will not knowingly publish private health details or sensitive personal information as a testimonial without appropriate permission.

17. Privacy

Your use of the website and services is also governed by our Privacy Policy. Where personal information is processed, we will handle it in accordance with that Policy and applicable law.

18. Third-Party Platforms and Links

Our services may involve third-party platforms, venues, software, payment providers, or links to external websites. We are not responsible for the operation, availability, content, terms, or privacy practices of third parties that we do not control.

19. Limitation of Liability

To the fullest extent permitted by law:

- EonYoga is not liable for indirect, incidental, special, punitive, or consequential losses

- EonYoga is not liable for loss of profits, loss of business, loss of goodwill, loss of opportunity, or data loss arising out of your use of the website or services

- EonYoga's total direct liability arising from a specific paid service will not exceed the amount you paid us for that service that gave rise to the claim

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded.

20. Complaints and Disputes

If you have a complaint, please contact us first at `hello@eonyoga.com` so we can try to resolve it quickly and fairly.

Nothing in these Terms prevents you from using any complaint, tribunal, or legal process available to you under applicable law.

These Terms are governed by the laws of South Africa, unless mandatory law in your place of residence requires otherwise. Subject to mandatory consumer rights, disputes may be brought in the competent courts of South Africa.

21. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the website with a revised "Last updated" date. Continued use of the website or services after an update takes effect means you accept the revised Terms, to the extent permitted by law.
